Ensuring the safety of shipping in the Republic of Kazakhstan

Abstract

Shipping in the Republic of Kazakhstan is one of the strategically important components of the country's economy. River navigation developed on those rivers where river transport could be used. Kazakhstan is landlocked, but it does have the Caspian Sea (lake), the status of which has been controversial for many years. And only on August 12, 2018, the Convention on the Legal Status of the Caspian Sea was adopted at the Fifth Caspian Summit of the Heads of State - Azerbaijan, Iran, Kazakhstan, Russia, Turkmenistan.

In view of marine access absence the questions of shipping safety in the Republic of Kazakhstan have not been treated in the publications in detail. However, the responsibility for transport crimes under the Criminal Code of the Republic of Kazakhstan, 2014, is provided for in Chapter 14 "Transport Criminal Offenses", including Article 344 "Violation of safety rules or operation of railway, air, sea or river transport". Our study examines this criminal offense; correct application of the norm helps ensure the safety of navigation in the country.
