Experimental legal regimes and their impact on the development of the intellectual property sphere
Abstract
The article is devoted to one of the topical, but poorly researched issues of assessing the impact of the application of experimental legal regimes on intellectual property. Today many countries seeking to create favorable conditions for the development of innovations actively apply experimental legal regimes or “regulatory sandboxes”. Such legal regimes make it possible to assess the effectiveness of a business model based on the use of innovations under conditions of temporary deviation from the provisions of the current legislation. At the same time, giving certain entities preferences in the form of the possibility to deviate from the law may have negative consequences, including for the development of intellectual property. The authors identify the main points of contact between the two spheres, study the problems arising in connection with the establishment of experimental legal regimes for the sphere of intellectual property, as well as offer their solutions.
